Title: Just got in a wreck
Post by: CHOKE on December 11, 2016, 06:05:47 AM
Was texting and ran into the back of a suv

My license is expired and my insurance card is from 2013

The police officer was so nice. It was cold outside so he let me sit in his car until my friend picked me up

We listened to some Katy Perry

Long story short I didn't get a ticket and my insurance will pay for everything

:blessed:

But how do u ram the back of someone and not get a ticket or have the driver of the SUV wanna lash u financially?

What's your insurance company? I want them if they pay for an accident that's your fault.

It's not a lie

He told me a story about a man that he pulled over who was driving with a Jason ski mask

He was so afraid to pull him over but when he did he told him to keep his hands above the steering wheel

He reached down and almost shot him

But he was looking for his license, he turned out to be a paper delivery man.

But yeah, he was going to give me a ticket for not paying attention but I told him damaging my car was punishment enough

I mean...sure. But if you're completely at fault, they're not so quick to cover. At least any company I've been with.

Their job is to investigate what happened to determine if they (you, the insurance company) are liable. If so, they are responsible for paying , up to your policy limits. If they don't feel you were 100% at fault, they are them responsible for providing a defense for you - up to your policy limits. Depending on the state, and their specific laws concerning negligence,  outcome of payment can differ.

Where do you reside and what companies have insured you? It should pretty much be spelled out in your insurance contract. And we're talking liability here, which is coverage for the other person's damages. You may be thinking of first party coverage, which your insurance won't pay you if you're at fault and you don't have collision coverage.

Although this story has some things that are questionable, everything about it is possible.

Wtf...did I offend?

Actually knowing someone fail to collect on an accident that for sure wasn't their fault, plus watching enough court tv shows, doesn't that constitute as experience?

If it happened the way Choke' said, how often does it end like that? Where everything is covered despite it being your fault. 2 times out of 10? And if Ckoke' says his premium won't go up, then something's fishy. If that's always the case, we all could drive how ever reckless we want as long as we got full coverage.

An insurcance company is gonna get out of paying anytime they can. They are a business. If u argue different, u must work for one

You didn't offend.

Standard insurance carriers are businesses. However they are held to the laws of the respective state's insurance governing body/agency and they have a duty to act in good faith.

I didn't make any mention of whether or not his premium will go up. I strictly spoke on the difference of first party and third party coverage and liability.

And "full coverage" has a very subjective definition. If I argue different, I just work for one? That's an illogical assumption. But ok.

I didn't say what I said at the end to offend. It's just that in this day and time, most people go off what other people have said without regard for the underlying facts. It's just the way of the world and social media.

You can watch all the shows, listen to all of the attorney ads, listen to all the people who have said what happened, but each state has their own laws and their own standard insurance contracts. Have you ever said down to read your auto insurance contract. It is just that...a contract. And if any insurance company breaches said contract, they can be sued and will pay heavily if they are found to be in breach of said contract.

But this story was made up it seems, so there's really no need to continue with this. However, most of the things I read in the original post could possibly happen.
