It's his responsibility to disclose if he has an STD like Herpes. His doctor would've told him to do so and to call a hotline number if he has had sex with any other person before he found out so he can get assistance with informing past sexual partners of him having Herpes. I've volunteered at health clinics and work in a hospital so I know a lot about these things.
