He can easily sue for defamation of character and go after big $$$ like CNN, Dallas Police Department, and many other news sources that had his pic on their site as the suspect. He's going to be filthy rich. Hope he had someone to save the emails and screencaped all the news reports.

The tricky part about defamation is that there has to be malice of intent. The majority of news reports "alleged" or "reported" what they were being told. Many then offered retractions.
Hopefully, he has a good lawyer well-versed in these kind of suits. Large media companies bury these kinds of suits without blinking an eye.

One doesn't need to prove malice or intent to bring an action for libel though, which is what I'm sure the action will be brought for (if one is brought). As long as you present something inaccurately as fact that does harm to a person's character or reputation, you can be awarded substantial damages.

I hope he gets a settlement or payout also. It may not be as quick and dry as I think some of us may want it to be.
One damning thing for the police department is the fact that even when it was determined that he was no way involved, his picture remained up for an UNUSUALLY long time. Harm to his character is very easy to prove in this instance. Death threats, etc. They put his life in danger even after they determined he was not involved.

Defamation of character claims require you to prove two things: 1. that what was said is completely untrue. 2. that the party(ies) who made such claims made them in an effort to cause harm.
The second part is what makes this form of tort law so damn complicated and difficult to prove.
It can definitely be proved that it caused harm.
And I'm sure that if he goes to interview for any job the interviewers will remember his face and deny him of the position because of the infamy

Which is why it would be foolish to bring the action for defamation as opposed to libel. The libel is easy to spot. His face was plastered all across the world in the print and electronic media, what was stated was untrue and it caused harm to his character and potentially physical harm. The standards and requirements are much higher for defamation of character, although a libel IS a form of defamation. There are exceptions to the requirement of malicious intent for defamation as well. If the statement was so vicious and reckless on its face, then a malicious intent would be inferred.
I see the Police Department using a defense of Public Safety to try to weasel their way out of any potential lawsuits, but I hope they do the right thing and settle with the guy.
