That is what HIV healthcare workers and policy makers here advocate though. What they say is that safe sex is an individual responsibility. Persons should assume everyone is HIV positive and take necessary steps to have safe sex. I'm kinda torn on this, because I see their point. In a perfect world I  would want to know if someone is HIV before having sex with them. But I also believe persons have a right to privacy. If they are taking steps to practice safe sex and not deliberately trying to infect others, then the onus is on me as well to insist on protected sex

But if 2 people are fucking, there isn't a way that only 1 of them decides to use protection. If the uninfected person insists on unprotected sex, then the duty is on the infected person to disclose, otherwise you're knowingly exposing someone to a deadly virus which is a crime I think? So at the end of the day the responsibility lies with the infected.
